bud is a children’s learning and lifestyle brand designed to help little explorers learn, watch, play and discover through educational content, creativity, nature-inspired adventures and play.

These Terms & Conditions (“Terms”) explain the rules that apply when you access or use the bud website, app, digital content, subscriptions, physical products and other services.

Please read these Terms carefully before creating an account, purchasing a product, starting a subscription or using our paid services.

By purchasing from us, creating an account or otherwise using a service that requires acceptance of these Terms, you agree to them.

Nothing in these Terms affects your statutory rights under UK consumer law.


1. About bud

bud is operated by a sole trader in the United Kingdom.

2. Children, Parents and Guardians

bud creates content and experiences primarily for children, including young children.

Purchases, paid subscriptions and account management must be carried out by a parent, guardian or other adult who is legally capable of entering into a contract with us.

Where you create an account, make a purchase or start a subscription for the benefit of a child, you are the contracting customer and are responsible for the account.

Children should use bud with the involvement and supervision of a responsible adult where appropriate.

Parents and guardians are responsible for deciding whether particular content, activities or products are suitable for the individual child using them.

We may introduce child profiles or similar features that allow children to access age-appropriate parts of bud through an account controlled or managed by a parent or guardian.


3. The bud App and Digital Services

Our app and other digital services may provide educational and entertainment content covering areas including:

Some content may be available free of charge while other content may require a purchase, membership or subscription.

We may add, replace, update or improve content and features as bud develops, subject to your consumer rights where changes affect something you have paid for.

We therefore cannot guarantee that using bud will result in a particular educational, developmental, academic or other outcome.

References to ages, developmental stages, subjects and skills are intended as general guidance and do not guarantee that particular content or activities will be suitable for every child.

Parents and guardians should use their own judgement when choosing content and activities for their child.


5. Accounts

Certain bud features may require an account.

When creating an account, you agree to provide information that is accurate and reasonably up to date.

bud must only be used for lawful, personal and non-commercial purposes unless we have expressly agreed otherwise.

7. bud Subscriptions

Where a subscription renews automatically, you authorise us or our payment provider to collect the applicable subscription charge using your selected payment method.

8. Billing

Subscription charges are normally collected in advance.

For monthly subscriptions, payment will normally be taken on or around the same date each month as the date on which your paid subscription began, unless we tell you otherwise before purchase.

Billing dates may occasionally vary where, for example, a month does not contain the equivalent calendar date or because of payment-processing circumstances.

Prices are displayed in GBP (£) unless otherwise stated.

Any applicable taxes or other charges will be dealt with as required by law and shown where appropriate.

Payments may be processed securely by third-party payment providers.

If a payment fails, we or our payment provider may attempt to collect the payment again.

We may suspend access to paid services or pause fulfilment of subscription products where payment remains outstanding.


9. Cancelling Your Subscription

You can cancel your bud subscription at any time.

You can cancel through your account where this functionality is available, or by contacting us at learn@budandfriends.com.

There is no cancellation fee.

Once you cancel, your subscription will not renew again after the current paid subscription period.

For digital subscriptions, unless we tell you otherwise, you will normally continue to have access to your subscription until the end of the period you have already paid for.

For subscriptions containing physical products, any box or product that has already been processed or dispatched may still be supplied as part of the subscription period already paid for.

Cancelling a subscription does not automatically entitle you to a refund for a subscription period that has already begun or been supplied.

However, this does not affect any cancellation, refund or other rights you have under UK consumer law.


10. Changes to Subscription Prices

We may change subscription prices from time to time.

If a price change affects an existing recurring subscription, we will provide reasonable advance notice before the new price takes effect.

Where required by law, we will obtain your agreement before applying a change.

If you do not wish to continue at the new price, you can cancel your subscription before the new price applies.


11. Physical Products

bud may sell physical products including:

Colours, packaging, positioning and appearance may vary slightly from images displayed on a screen.

We may occasionally substitute materials or components where necessary because of availability, provided the substitution does not materially reduce the overall nature, quality or value of the product.

We may send an acknowledgement confirming that we have received your order.

A binding contract will be formed in accordance with the information provided during checkout and our order-confirmation process.

13. Prices and Payment

If circumstances outside our reasonable control cause a delay, we will take reasonable steps to minimise the effect of the delay and will comply with our obligations under applicable consumer law.

You are responsible for providing a complete and accurate delivery address.

15. Your Statutory Rights

Nothing in these Terms removes, limits or replaces rights you have under UK consumer law.

Where required by law, before paid digital content is supplied during a statutory cancellation period, we may ask you to expressly agree to immediate supply and acknowledge the effect that beginning supply may have on your cancellation rights.

Nothing in these Terms removes any rights you have where digital content is faulty, does not match its description or otherwise fails to conform to the contract.


19. Refunds

Where you are legally entitled to a refund, we will process it in accordance with applicable consumer law.

Refunds will normally be made to the original payment method unless otherwise agreed.

The time taken for funds to appear after a refund has been issued may depend on your bank or payment provider.


20. Adult Supervision and Safety

bud encourages children to explore, create, move, learn and play.

If you are uncertain whether an activity or product is suitable for a child because of an allergy, medical condition, disability or another individual circumstance, you should seek appropriate professional advice before use.

Some bud content and activities may encourage children and families to explore outdoors.

Outdoor environments naturally involve risks outside our control, including:

We will aim not to require a child to provide more personal information than is reasonably necessary for the relevant feature or service.

Messages that are necessary to administer an account, purchase, order or subscription are service communications and are different from optional marketing.


33. Our Responsibility to You

We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed.

If you are a consumer resident in England or Wales, you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also have rights to bring proceedings in your local courts.

Nothing in this section removes any mandatory legal protections available to you.
